If you lose at an administrative agency or in a trial court, you have the right to appeal. Appeals are generally on the record, that is, based on the record before the administrative agency or a trial court. Appeals do not provide for a new trial in the appellate court.

Appeals on the record involve arguing error by the judge, jury, or fact finder in the lower court or the administrative agency. Arguments are based on the record before the decision-maker(s) in the lower court or administrative agency, the applicable law, and application of that law to the decision in the lower court or administrative agency.

Generally, the most important part of the appeal on the record is the initial brief, whether you are initiating the appeal or defending against it. Persuasive briefs require thorough analysis of the record in the lower court, exhaustive research of the legal issues involved, and a well written legal argument.
